Below are the new regulations and policies that will take effect from June 2022.

New regulations on establishment and transformation of enterprises in which 100% charter capital is held by the State

Decree No. 23/2022/ND-CP dated April 25, 2022 of the Government on the establishment, rearrangement, ownership conversion and transfer of the right to represent the owner in enterprises in which 100% capital is held by the State The charter takes effect from June 1, 2022.

In particular, the Decree stipulates that when established, enterprises must have a charter capital of not less than 100 billion VND.

In case of business lines and trades that require legal capital, in addition to the above conditions, the charter capital of the enterprise upon establishment must not be lower than the legal capital level prescribed for such business lines.

For enterprises providing essential public products and services, ensuring social security, or operating in a number of industries, fields or geographical areas that require capital investment from the State to establish an enterprise, the charter capital shall be may be less than 100 billion dong but not lower than the legal capital prescribed for business lines and industries requiring legal capital.

New regulations on vocational training association with foreign countries

Decree 24/2022/ND-CP amending and supplementing Decrees stipulating conditions for investment and operation in the field of vocational education takes effect from June 1, 2022.

Decree 24/2022/ND-CP amending and supplementing regulations on training association with foreign countries specified in Decree 15/2019/ND-CP dated February 1, 2019.

Accordingly, regarding the forms of training association with foreign countries, Decree 24/2022/ND-CP stipulates: Joint training with foreign countries shall be conducted according to the following training programs:

Training program developed by both parties; grant foreign diplomas and certificates or grant foreign and Vietnamese diplomas and certificates;

Foreign training programs; grant foreign diplomas and certificates;

Transferring foreign training programs; grant foreign diplomas and certificates or grant foreign and Vietnamese diplomas and certificates.

Joint training with foreign countries is implemented entirely in Vietnam or partly in Vietnam and partly abroad as decided by the training partners.

Postage service discount does not exceed 50% of the most recent postage rate

Effective from June 1, 2022, Decree No. 25/2022/ND-CP amending and supplementing a number of articles of Decree No. 47/2011/ND-CP dated June 17, 2011 of the Government detailing the implementation of a number of contents of the Postal Law.

In which, the Decree supplements Article 15 dd on promotion in the provision of postal services. Specifically, the promotion in the provision of postal services shall comply with the provisions of the law on commerce.

The maximum discount rate for postal services promoted in the form of a discount must not exceed 50% of the most recent postage rate announced and announced in accordance with regulations.

Honorary consuls perform consular functions not for profit

Decree No. 26/2022/ND-CP dated April 14, 2022 on foreign honorary consular officers in Vietnam takes effect from June 1, 2022.

On the principle of performing consular functions, the Decree stipulates that: Honorary consular offices and honorary consulates are only allowed to perform consular functions in certain consular areas in Vietnam after being approved by the Ministry of Industry and Trade. The Diplomatic Corps of Vietnam issues the Honorary Consular Acceptance Certificate on the basis of conformity with international and Vietnamese laws.

Honorary consular officers perform consular functions not for profit or economic benefit but to promote relations between the sending State and Vietnam.
