Hai Phong: Strong Authorization to Grassroots Levels to Resolve Land Bottlenecks

On February 25, 2026, the Hai Phong City People's Committee issued Decision No. 689/QD-UBND, marking a significant step in promoting administrative reform and enhancing the efficiency of state land management within the city. Based on the Land Law 2024 and the latest regulations in Decree No. 49/2026/ND-CP, the city decided to directly authorize the Chairman of the City People's Committee and the Chairmen of Commune-level People's Committees to perform many key tasks. This authorization aims to resolve difficulties and obstacles in implementing the Land Law while applying more flexible administrative procedures suited to local realities.

Accordingly, the Chairman of the City People's Committee is authorized to handle major task groups, such as:

  • Deciding on land allocation, land lease, and land-use purpose conversion for large-scale projects, specialized water-surface land, and land within high-tech zones or civil airports.
  • Deciding on land recovery for cases violating land laws.
  • Establishing councils to appraise land price tables and specific land prices.
  • Managing and performing tasks related to the land funds of agricultural and forestry companies.

Notably, the authority of the Chairmen of Commune-level People's Committees has been significantly expanded to resolve issues at the grassroots level quickly. Their authorized duties include:

  • Compensation and Site Clearance: Issuing land recovery notices; approving compensation, support, and resettlement plans; and approving land recovery enforcement plans.
  • Residential Land Management: Deciding on land allocation and land lease for individuals, households, and residential communities; approving land-use rights contribution plans for the renovation and development of rural residential areas.
  • Council Formation: Establishing compensation, support, and resettlement councils as well as specific land price appraisal councils for authorized cases.

To ensure the Decision is implemented promptly, on March 1, 2026, the Department of Agriculture and Environment issued Document No. 2053/SNNMT-QLDD for guidance. The Department requires relevant agencies and commune-level People's Committees to actively propagate and disseminate the details of this authorization to citizens and businesses. Authorized subjects must be fully responsible to the City People's Committee for the implementation and are required to submit annual periodic reports on the results of their assigned tasks. This Decision, effective from the date of signing, is expected to create a seamless coordination mechanism between levels of government, contributing to making Hai Phong a highlight of administrative reform in the land sector.
