
To ensure the uniform implementation of new Government regulations regarding labor and service contracts for certain civil servant tasks, the People’s Committee of Hai Phong City issued Official Dispatch No. 315/UBND-NVKTGS on February 15, 2026. This dispatch provides guidance to Departments, agencies, and commune-level People’s Committees on the following key contents:
- Developing Annual Plans
Departments, agencies, and People’s Committees at communal, ward, and special ward levels are responsible for proactively synthesizing and developing contract signing plans for their respective agencies and localities, including subordinate units. These plans must align with task requirements and resource capacity, clearly defining the sector, field, target, and work content. Additionally, plans must specify product results, implementation timelines, funding sources, budget estimates, and payment methods.
- Regulations on Policy Approval Authority
Before signing contracts, units must approve or submit for approval policies according to three task groups defined in Article 4 of Decree 173:
- Submit to the Chairman of the City People’s Committee: For tasks associated with leadership or management positions that are strategic, sudden, urgent, or non-regular.
- Submit to the Department of Home Affairs: For specialized or professional tasks that are specific, in-depth, require high qualifications, or are seasonal.
- Self-approval by the head of the agency or locality: For professional or internal support tasks where existing human resources are insufficient to meet requirements.
- Authority for Deciding on Contract Signing
Once the policy is approved, the authority to decide on signing contracts is decentralized as follows:
- Chairman of the City People’s Committee: Decides on signing service contracts for the leadership and management task group.
- Directors of Departments/Agencies and Commune-level People’s Committee Chairmen: Decide on signing service contracts for the internal support group and labor contracts for the specific professional group after obtaining approval from the Department of Home Affairs.
- Heads of Sub-departments and equivalents: Decide on signing contracts for tasks within their decentralized management scope.
- Application of Contract Templates and Funding
- Contract Templates: Agencies must strictly apply the contract templates guided by the Ministry of Home Affairs in Circular No. 16/2025/TT-BNV.
- Funding: The estimation, allocation, and finalization of state budget funds must comply with Article 13 of Decree 173 and the Ministry of Finance's guidance in Circular No. 144/2025/TT-BTC.
- Reporting and Inspection Regime
- Departments, agencies, and commune-level People’s Committees must periodically synthesize and report contract signing results to the City People’s Committee (via the Department of Home Affairs) no later than December 1 each year.
- The Department of Home Affairs is responsible for guiding document procedures, advising the City Chairman on policy approval, and inspecting implementation across localities.
- The Department of Finance leads the guidance for units on budget estimation and the arrangement of implementation funds.
The City People’s Committee requires units to implement these guidelines strictly to ensure the attraction of high-quality, experienced human resources to enhance the effectiveness and efficiency of state management in the locality.
